Privacy notice for online applications submitted through Personio:Skytanking takes compliance with data protection law requirements very seriously. In this document, Skytanking, and in particular the company that you are applying with (hereinafter referred to as “SKYTANKING”), would like to inform you about how they collect your personal data in the context of the recruitment processes and programmes. Data controller
The controller for the collection and processing of data is the Skytanking company you are applying with. During the application process, SKYTANKING will process the personal data the company receives from you in the context of your application.
Data processed by SKYTANKING
During the application process, we process the data we need from you in the context of your application. All personal data you provide to SKYTANKING in the context of your application is processed. In particular the following data:
Surname
First name
Date of birth
Contact data (address, telephone number, email address, etc.)
As applicable, nationality and work permit
Application data (resume, cover letter, academic transcripts, letters of recommendation) and anything else you may make available to SKYTANKING and communicate during job interviews
The photo included with your job application
A Criminal Records Bureau check and data regarding your physical ability to perform the work where this is required for the vacancy advertised
Bank account data for the reimbursement of travel expenses, where applicable
Voluntary information:
As a general principle, we only collect data that [is required by law/ is required on the basis of a contract/ is required to execute a contract].
However, there is no obligation to provide [e.g. your phone number or email]. There are no negative consequences if you do not provide this data. On the other hand, [any subsequent communication may be made more difficult and/or delayed] in individual cases if you do not provide this information.
Submitting an application through LinkedIn
You can import the personal data that is stored in your LinkedIn profile. If you use this feature, you allow us to access the personal data you have stored there. We only access this data one single time. If you update your profile on LinkedIn, it will not automatically be updated in our system.

Purpose of data processing and legal basis
SKYTANKING processes the aforementioned personal data in order to review your suitability for the position (or, as applicable, other vacancies at the Marquard and Bahls Group) and to perform the application process in the context of making the decision as to whether to execute an employment agreement based on Art. 88 GDPR in conjunction with the national laws.
If the data is required after the application process has been completed, e.g. to bring a legal action or to defend against claims, data may be processed based on the conditions specified in Art. 6 GDPR, in particular to pursue legitimate interests in accordance with Art. 6 I 1(f) GDPR. In this event, the interests of SKYTANKING are the assertion of or defence against claims. Where data processing is based on Art. 6 I 1(f) GDPR, you have the right to object to the processing of the data. More detailed information on this will be provided under “Your data protection rights” below.
Recipients of your data
Upon receipt of your application, your applicant data will be viewed by SKYTANKING's HR departments
Suitable applications are forwarded internally to the department personnel in charge of the respective vacancy. The next steps of the process are coordinated with them. As a general rule, only those additional persons who need this access for the proper performance of the application process have access to your data.
Additional possible recipients of your personal data are, for example:
SKYTANKING's processors, as defined in Art. 28 GDPR, e.g. for supporting/maintaining EDP/IT applications used to operate the applicant portal, in particular Personio other data recipients based on a consent granted by you. There may also be additional legal obligations to transfer data in individual cases which do not apply in general, though, but may only arise in specific individual cases.
Data transfer to third countries
The Skytanking is a group of companies operating worldwide in which the responsibilities for personnel extend beyond individual departments, companies and countries. Data is only transferred to countries outside of the EU and/or the European Economic Area (third countries) if the European Commission has deemed data protection adequate in that country or if appropriate guarantees for the lawfulness of the data transfer are in place, such as an agreement on the application of EU standard data protection clauses in accordance with Art. 46 II(c) GDPR, and/or where this is necessary to decide on whether an employment agreement should be executed, is required by law (e.g. reporting obligations under tax law), where you have granted your consent to the transfer, or in the context of contract data processing.
Where SKYTANKING uses service providers in third countries, they are also placed under an obligation to comply with an adequate data protection level through appropriate measures (e.g. an agreement on the application of EU standard contractual clauses).
We will gladly provide a copy of the respective guarantee to you upon request.
Data storage period
Unless there is a statutory retention period, data is erased when its storage is no longer required or when the legitimate interest in storing the data no longer exists. If the applicant is not hired, data is regularly deleted at the latest six months after the completion of the application process unless shorter periods are provided for by applicable law.
In individual cases, some data may be stored for longer periods (e.g. for travel expense accounting purposes). In this event, data is stored in accordance with the national statutory retention periods.
If SKYTANKING hires you, the company will transfer your application data to your personnel file. If SKYTANKING did not hire you, but your application is still of interest to the company, SKYTANKING will ask you if it can keep your application for future vacancies.
Your data protection rights:
You, as the data subject, have the right to receive information on the personal data concerning you, to have inaccurate data rectified, or to have data erased where one of the reasons specified in Art. 17 GDPR exists, e.g. if that data is no longer required for the purposes pursued. In addition, you have the right to demand that the processing be restricted where any of the situations specified in Art. 18 GDPR applies, and, in the cases specified in Art. 20 GDPR, you have the right to data portability.
Where data is collected based on Art. 6 I 1(f) GDPR (data processing for the purposes of the legitimate interests pursued), you have the right to object to the processing, on grounds relating to your particular situation, at any time. In that event we will no longer process the personal data unless it can be proven that there are compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or unless data is processed for the establishment, exercise or defence of legal claims.
Data subjects have the right to lodge a complaint with a supervisory authority if they believe that the processing of their data violates data protection regulations. In particular, they can lodge this complaint with a supervisory authority in the Member State of their habitual residence or place of work or the place of the alleged violation.
